Powers Of Attorney

A Power of Attorney is an important and useful document where you can appoint others to make decisions on your behalf. In Ontario, there are two types of powers of attorney for two different circumstances. It is advisable to do both types so that you are covered in any situation. When doing both types at one time, we are pleased to offer a considerable discount. There are further discounts available if you opt to do your Will at the same time and also if you and your spouse receive mirror Wills.

 

Continuing Power of Attorney (for Property)

 

A Continuing Power of Attorney allows the person or persons you appoint to manage all of your financial affairs. The Substitute Decisions Act (Ontario) allows this type of power of attorney to “continue” to operate even if you become incapable. It can also be used when you are fully capable if you supply the document to the person you have appointed.

There is also a Specific Power of Attorney that we can draft in situations where you only want to give an individual temporary or limited powers (for instance, if you are leaving the country for some time and need someone to look after your financial and legal affairs).

 

Power of Attorney for Personal Care (Living Will)

 

A Power of Attorney for Personal Care (sometimes referred to as a ‘living will’) allows the person(s) you appoint to make health care decisions for you based on your previous instructions. This type of power of attorney only operates if you are incapable of making decisions for yourself. In other words, if you are able to make your own health care decisions, you will be the one making those decisions.

You can set out broad or detailed instructions in your Power of Attorney for Personal Care relating to what types of treatment or measures your attorney(s) may authorize, whether or not you wish to be placed in an institution, etc.

No Prior Appointments Are Required For Notary Services.

When You Bring Your Document(S) In To Be Either Commissioned Or Notarized, We Must Then Verify Your Identity And After Satisfaction Of The Genuineness Of Your Signature, We Will Administer The Oath Or Solemn Declaration.  We Do Not Certify That The Content Of The Declaration Is True But Only That Your Signature Was Witnessed And That The Oath Or Solemn Declaration Was Administered Properly.

Examples Of When You Would Need A Statutory Declaration Filled Out Would Be;, Unauthorized Use Of A Credit Card Or Debit Card Or A Travel Letter. A Lost Or Stolen Passport, Construction Lien Declarations, Lost Or Stolen Identification Some Major Lenders, Government Offices And Financial Institutions Will Supply You With The Documents You Will Need To Bring In With You.  Please Do Not Sign These Documents In Advance Until You Are Instructed To Do So And In The Presence Of A Lawyer.

CONTRACT REVIEW

 

It seems like almost every day there are Contracts or “Standard” Terms and Conditions that we are faced with. From banking agreements to employment contracts, leases, website registrations, real estate listing agreements, credit card agreements and the plethora of other services we sign up for, no doubt they are filled with ‘legalese’. We would be happy to ‘translate’ those contracts for you into terms that you can understand so that you appreciate what you are signing. Demand Letters

 

It can be frustrating when you are legally owed money but for some reason you can’t collect. The first step is sending a demand letter on our letterhead to show that you are serious about collecting the debt. Until we get involved, the debtor sometimes thinks that you won’t escalate the matter and may cut your losses. Once we get involved, they realize that you have raised the stakes. In many cases, the debtor will be responsible for your legal fees as well so that you are not out of pocket.

Demand letters are also useful as ‘cease and desist’ letters where someone is infringing on your legal rights (whether it be using your trademark or failing to live up to some contractual obligation).

Refinance
